Trucking Accidents Present Unique Legal Issues

While automobile accidents can often result in serious injuries, life-changing injuries are more likely to occur when a truck is involved.  In determining the liability of a truck driver, there are many factors that do not exist in the typical car accident.  Therefore, when you have been injured in an accident involving a truck, it is important to seek the advice of a knowledgeable lawyer.

With these cases, a lawyer must be involved from as early as possible to establish each and every person who may be responsible for the crash.  This could include the truck driver, the truck driving company, the freight or loading company, as well as any facility that may have serviced the truck.  Additionally, truck drivers are not held to a simple negligence standard, but must also adhere to standards established by the Federal Motor Carrier Safety Administration.

If there is a violation of any of the rules promulgated under the Administration, liability could attach.  For example, the MCSA has rules regulating the hours of service and the keeping of driving times and vehicle inspections for truck drivers and trucking companies.  A violation could prove to be a significant factor in establishing liability in a litigated matter.
