New Jersey may expand its wrongful death statute to allow the recovery of damages for mental anguish, emotional pain and suffering, loss of society, and loss of companionship. Currently, damages are limited to pecuniary losses and funeral expenses. The proposed change enables surviving family members to seek compensation for the emotional and psychological impact of losing a loved one due to another's wrongful act. Should the legislation pass, the proposed amendment would apply to all wrongful death actions arising on or after the date that the amendment is signed into law.
